Needless to say, drinking and driving is a real social issue.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To help you understand the legal provisions governing the offence of drinking and driving, let\u2019s shed some light on a few popular beliefs.<\/p>\n\n\n\n<h3 id=\"h-1-my-blood-alcohol-level-is-not-over-80-mg-of-alcohol-100-ml-of-blood-so-i-m-fine\" class=\"wp-block-heading\"><strong>1. My blood alcohol level is not over 80 mg of alcohol \/ 100 mL of blood, so I\u2019m fine!<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">That\u2019s a myth! The <em>Criminal Code<\/em> does not only prohibit driving with a blood alcohol concentration above the legal limit of 80 milligrams of alcohol per 100 millilitres of blood. It also makes it a crime to operate \u201ca conveyance while the person\u2019s <strong>ability to operate it is impaired to any degree <\/strong>by alcohol or a drug or by a combination of alcohol and a drug.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So a person who drives while their ability to drive is impaired by alcohol commits a criminal offence even if their blood alcohol level is below the legal limit. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As the <em>Criminal Code<\/em> now specifies, the <strong>impairment <\/strong>does not need to be significant. The prosecution only has to prove <strong>beyond a reasonable doubt<\/strong> that the accused\u2019s ability to drive was impaired by alcohol.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This can be proven in several ways. Generally, the police officer who arrested the accused will be called to testify about what they observed.  <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The following could be relevant:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>How the accused was driving: weaving from one lane to another, driving erratically, scraping another vehicle, causing an accident;<\/li>\n\n\n\n<li>The accused\u2019s physical condition: dry mouth, difficulty speaking, red eyes, slow movements;<\/li>\n\n\n\n<li>An odour of alcohol on the accused\u2019s breath;<\/li>\n\n\n\n<li>The accused\u2019s statement about their alcohol consumption (if it was made freely and voluntarily);<\/li>\n\n\n\n<li>Etc.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">If you have been charged with impaired driving, <a href=\"https:\/\/www.verreaudufresneavocats.com\/en\/contact\/\">meet with one of our criminal law lawyers today<\/a> to have your situation reviewed. <\/p>\n\n\n\n<div class=\"wp-block-advgb-button aligncenter\"><a class=\"wp-block-advgb-button_link advgbbtn-53bf8ee2-ccb1-4c62-8d02-2f816a5f4f21\" href=\"#footer\" target=\"_self\" rel=\"noopener noreferrer\"><span>I would like advice<\/span><\/a><\/div>\n\n\n\n<h3 id=\"h-2-i-refused-to-blow-so-they-can-t-prove-anything-against-me\" class=\"wp-block-heading\"><strong>2. I refused to blow, so they can\u2019t prove anything against me!<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">You refused to blow into the \u201cballoon\u201d and think you\u2019ve gotten off easy? Things are far from that simple. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">First, refusing to comply with a valid police demand to blow into the approved screening device (ASD) or the breathalyzer is a criminal offence. A person who <strong>fails or refuses to comply<\/strong> with the police demand without a reasonable excuse faces criminal charges and, if convicted, a minimum fine of <strong>$2,000<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Second, evidence that the accused refused or failed to blow into the device can be admitted against them. In a prosecution for impaired driving, this evidence allows the court to draw an inference unfavourable to the accused.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In short, it is true that refusing to blow prevents the police officer from gathering evidence of a person\u2019s blood alcohol level. However, the refusal can be used against the accused to establish that their ability to drive was impaired by alcohol.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><em><strong>Did you know?<\/strong> A person who does not blow properly into the device, making it impossible to obtain results, also faces a charge of failing to comply with a demand. <\/em> <\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">If you refused to provide a sample into the approved screening device or the breathalyzer, you face serious consequences. Anyway, I\u2019ll just have to pay a fine!<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">It\u2019s true that if you are convicted of alcohol-impaired driving or of driving with a blood alcohol level over the legal limit, you could be ordered to pay a fine. But that\u2019s not all.<\/p>\n\n\n\n<h4 id=\"h-the-fine\" class=\"wp-block-heading\"><strong>The fine<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">First, you should know that if you are convicted, the <strong>minimum fine <\/strong>is <strong>$1,000<\/strong>. Regardless of your financial means, the court cannot reduce this amount. Depending on the blood alcohol level proven by the prosecution, this minimum amount could be higher.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If your blood alcohol level is between 120 and 160 mg of alcohol per 100 millilitres of blood, the minimum fine is <strong>$1,500<\/strong>. If your blood alcohol level is 160 mg of alcohol per 100 millilitres of blood or higher, which is twice the legal limit, the minimum fine is <strong>$2,000<\/strong>.<\/p>\n\n\n\n<h4 id=\"h-imprisonment\" class=\"wp-block-heading\"><strong>Imprisonment<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Note that these minimum fines only apply to a <strong>first offence<\/strong> of impaired driving. From the second offence on, the minimum sentence is <strong>imprisonment<\/strong>: <strong>30 days<\/strong> for a second offence and <strong>120 days<\/strong> for each subsequent offence. These are only the minimum terms of imprisonment. The offence of impaired driving is punishable by up to 10 years\u2019 imprisonment.<\/p>\n\n\n\n<h4 id=\"h-driving-prohibition\" class=\"wp-block-heading\"><strong>Driving prohibition<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">A judge who convicts you of impaired driving must impose a <strong>driving prohibition<\/strong>. This prohibition applies to all types of motor vehicles, not just the one used when the offence was committed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Once again, a minimum penalty applies. For a first offence, the court must impose a driving prohibition of <strong>one year<\/strong>.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><em>Note that, in some cases, the court may allow you to immediately use an ignition interlock device in your car so that you can drive. However, the Soci\u00e9t\u00e9 de l\u2019assurance automobile du Qu\u00e9bec (SAAQ) is responsible for issuing these devices, according to its procedures and at the prescribed cost.<\/em> <\/p>\n<\/blockquote>\n\n\n\n<h4 id=\"h-criminal-record\" class=\"wp-block-heading\"><strong>Criminal record<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Finally, a conviction for a criminal drinking and driving offence results in a <strong>criminal record<\/strong>. It is therefore wrong to think that this offence only leads to paying a fine. I was resting in the car, so the police had no right to arrest me!<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">It is important to know that, for impaired driving, the concept of \u201coperating\u201d in the <em>Criminal Code<\/em> is much broader than the dictionary definition.
