The administrative law team at Verreau Dufresne Avocats handles situations involving the interpretation and implementation of government programs and services.
If you believe that the government or one of its officials made an error in a decision granting or denying compensation or a right, specialized administrative tribunals can intervene to change the decision.
It is then important to retain a lawyer who knows how these tribunals work, as they generally have their own rules of evidence and procedure.

The role of administrative tribunals
Administrative tribunals are not courts of law. While courts decide disputes between citizens or businesses, administrative tribunals decide disputes involving the State.
The primary goal of administrative law is to ensure that the government and its officials implement laws properly, interpret them correctly and apply legislation fairly.
To that end, various tribunals have been set up in Quebec to oversee government practices. They are specialized and have exclusive jurisdiction over administrative law matters.
The various administrative tribunals
- Tribunal administratif du Québec (TAQ – Administrative Tribunal of Québec): decides a large number of proceedings involving the government’s financial or political interests;
- Tribunal administratif du travail (TAT – Administrative Labour Tribunal): specializes mainly in contesting decisions rendered by the CNESST and in proceedings related to labour relations;
- Tribunal administratif des marchés financiers (Financial Markets Administrative Tribunal): decides matters related to financial markets;
- Régie du bâtiment du Québec (RBQ): administrative body governing the quality of construction work, the qualification of professionals, building safety and the integrity of contractors. It adopts standards and ensures compliance with them. It can also conduct investigations, impose fines and require financial guarantees;
- Tribunal administratif du logement (TAL – Administrative Housing Tribunal): decides disputes relating to residential leases;
- Régie de l’énergie (Quebec Energy Board): protects consumers and ensures fair practices by electricity distributors;
- Régie des alcools, des courses et des jeux (RACJ): oversees the alcohol sector, lotteries, casinos, contests, draws, etc.;
- Régie des marchés agricoles et alimentaires du Québec (RMAAQ): regulates agricultural and food markets, taking into account consumer interests and the public interest;
- Commission d’accès à l’information (CAI): oversees access to documents held by public bodies and the protection of personal information in the public and private sectors;
- Commission de la fonction publique (Public Service Commission): oversight body and administrative tribunal that ensures access to the public service, the competence of those hired and the fairness of human resources management decisions;
- Commission de protection du territoire agricole du Québec (CPTAQ): decides applications for authorization required under the Act respecting the preservation of agricultural land and agricultural activities;
- Commission des transports du Québec (CTQ): oversees carriers and renders decisions in a variety of files involving them;
- Commission municipale du Québec: tribunal and administrative body for investigations and advice on municipal matters;
- Commission québécoise des libérations conditionnelles (Quebec Parole Board): decides applications for the conditional release of detained persons;
